Re: Safety of Work in connection with Environment
(Chemical Substance)
  1. Intention of the Law
    To protect the employee from the danger of chemical substances which are used in business premises.


  2. Framework and Enforcement of the Law
    To prescribe the control of quantity of 121 chemical substances dispersed in workplaces in form of dust, fume, gas, vapor, and fiber. If the employee uses such chemical substances, the dispersion must be controlled according to the standards in the Tables 1-4 attached to the notification.

  3. Main Points of the Law
    The law imposes the quantity of chemical density allowed to exist in the atmosphere in the Table 1-4 as follows:     

    Table 1 indicates the average quantity of chemicals allowed to exist in the atmosphere throughout working hours. The density must not be higher than the specified limits.

    Table 2
    indicates the quantity of chemical substances allowed to exist in the atmosphere at any time during working hours. The quantity shall not exceed the specified limits.

    Table 3 indicates the quantity of chemicals allowed to exist in the atmosphere, the average quantity of the chemicals throughout working hours and the maximum quantity of the chemical density in the specified period.

    Table 4
    indicates the quantity of chemicals, in form of mineral dust, allowed to exist in the atmosphere throughout the working hours. The quantity of mineral dust shall not exceed the specified limits.

    The employer is not permitted to let the employee work in the place where the chemical density exceeds the standard quantity specified in Tables 1-4. Hence, the employer shall have measurement of the chemical quantity dispersed in the atmosphere, and compare to the standard quantity imposed by the law.


    Remedy
    In case the chemical substances dispersed in the atmosphere of workplaces in excess of the quantity specified in Table 1-4, annexed to this Notification, the employer shall make modification to reduce the density of the chemical to be in line with the specified limit in the Tables.

    Prevention Procedure
    When the quantity of chemical substances, dispersed in the atmosphere, exceeds the standard specified by the law, the employer shall conduct modification and rectification to prevent dangers and diseases as follows:
    1. To reduce the quantity of the substances, the employer is able to carry out various methods of modification and rectification, such as, using the air-ventilation system.
    2. If the modification cannot be made to reduce the quantity because working obstacles or technical problems will occur, the employer shall provide the employee with personal safety equipment and that equipment must be suitable to kinds of chemical substances.
